1. Services Provided
Safe Pace Lift LLC ("Company") provides forklift operator training , on-site forklift inspections, and minor
forklift repairs ("Services") to clients ("Client") at their designated location(s). All Services are subject to availability
and scheduled by mutual agreement
2. Client Responsibilities
- The Client agrees to provide a safe, accessible, and compliant work environment for the Company to conduct its
Services.
- The Client is responsible for ensuring that all personnel participating in training sessions meet minimum age and
physical capability requirements for forklift operation
- The Client must disclose any known hazards or unsafe equipment conditions prior to any inspection or repair work.
3. Service Limitations
- The Company does not guarantee that any forklift, after training , inspection , or minor repairs, will be in full compliance
with OSHA or other regulatory standards unless explicitly stated in writing.
- Minor repairs exclude overhauls, heavy disassembly, or work requiring specialized parts procurement.
4. Payment Terms
- All fees are due according to the invoice terms. A late fee of 10% per month will be applied to overdue balances.
- Travel fees may apply for on-site services beyond a 50 mile radius from Apache Junction, AZ.
5. Cancellations
- Cancellations must be made at least 48 hours in advance to avoid a cancellation fee.
- Rescheduling is subject to availability.
6. Warranties and Disclaimers
- Services are provided "as is" and without warranties of any kind, express or implied.
- The Company makes no warranties regarding the future performance or safety of forklifts following inspections or
repairs .
Indemnification Clause
Indemnification:
The Client agrees to indemnify, defend, and hold harmless Safe Pace Lift LLC, its officers,
employees, agents, and subcontractors from and against any and all claims, liabilities, damages, losses,
and expenses (including reasonable attorneys' fees) arising out of or in connection with :
a) any breach of these Terms & Conditions by the Client;
b) any negligent, reckless, or willful acts or omissions by the Client or its employees;
c) any injury, death , or damage to property related to or arising out of the use of forklifts operated by persons trained by
the Company, unless directly caused by gross negligence or willful misconduct of the Company;
d) any claims arising out of the condition of the Client's premises or equipment.
